CHAPTER 13 BANKRUPTCY PLANS

I appeared in Jefferson City last week to argue a case dealing with the corollary of the holding of In re Frederickson. Frederickson dealt with an above-median debtor, while my case involves a below-median debtor. However, the issue is the same to the extent that both cases involve debtors who are attempting to confirm plans that run less than a set amount of time (60 months in Frederickson, 36 months in my case). I expect a decision will be handed down in the next two to three months.
